Changes and Returns
01 The passenger may obtain a refund of the amount of the ticket from the shipping companies, in case of not making use of it, and provided that the contracted rate allows it, in accordance with the following conditions:
a). After deducting 10 percent of the amount of the ticket from the advance sale, if the request is submitted within 7 days before the departure of the ship.
b). For refunds submitted within 48 hours and before 2 hours prior to the departure of the ship, 20 percent of the amount of the ticket will be deducted.
c). Tickets presented for cancellation and/or modification less than two hours before the ship's departure will not be refunded, whether the reservation was made on the same day of departure or before.
02 All BALEARIA fares and "mini" offers allow changes of date and/or time of travel with a penalty of €20 per reservation plus the possible increase in the rate, if any, as long as the change is made within 2 hours prior to the date and time of departure of the initially contracted trip. The full and "reduced" fare of BALEARIA allow changes without penalty of €20 but there could be an increase in the fare from one date to another, as long as they are made within 2 hours prior to the departure date and time of the initially contracted trip.
03 Schedules and itineraries may be subject to variations due to breakdowns, fortuitous events or force majeure. In such cases, BALEARIA will adopt the measures under its control to notify the affected passengers of said variations. In case of necessity motivated by the previous causes, the shipping company can be replaced by a ferry company or use other ships.
04 In the event that the contracted trip is not carried out, due to breakdown, fortuitous event or force majeure, the ferry company assumes no more responsibility than the obligation to reimburse the full amount of the ticket.
05 Passengers who do not board, for any reason beyond BALEARIA's control, will not be entitled to a refund of the amount of the ticket.
06 The tickets issued OPEN (open return) of BALEARIA are valid for one year from the date of issue, their use being subject to the prior reservation of a place. The contracted rate will be maintained until January 15 of the following year. After this date, the return can be closed by paying the supplement corresponding to the year's rate increase.
07 The transport of vehicles covered by this ticket is carried out in accordance with current regulations on the matter and by international agreements signed by Spain.
08 For the exercise of actions derived from this ticket in national cabotage navigation lines, the jurisdiction that results from applying the Civil Procedure Law in force will be applied. When maritime transport is carried out on international lines, it will be subject to the jurisdiction of the Courts resulting from the application of the 1974 Athens Convention and/or the instruments that modify it.
09 The passenger has the right to withdraw from the contract related to passenger transport within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days after the conclusion of the contract.
To exercise the right of withdrawal, the passenger must notify the company (inserting his name, his full address and, if available, his telephone number, his fax number and his email address) his decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email).
To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.
Consequences of withdrawal:
In case of withdrawal by the passenger, the company will return all payments received from the passenger's transport, including delivery costs (with the exception of additional costs resulting from the choice on your part of a delivery method other than the one least expensive mode of ordinary delivery offered) without undue delay and, in any case, no later than 14 calendar days from the date on which you are informed of your decision to withdraw from your contract.
The company will proceed to make said reimbursement using the same means of payment used by the passenger for the initial transaction, unless it has expressly provided otherwise; in any case, you will not incur any expenses as a result of the reimbursement.
